Subclass 482 - TSS Temporary Skill Shortage Visa
On 18 April 2017, the Hon Malcolm Turnbull MP, Prime Minister of Australia and the Hon Peter Dutton MP, Minister for Immigration and Border Protection jointly announced that the Temporary Work (Skilled) visa (subclass 457 visa) will be abolished and replaced with the completely new Temporary Skill Shortage (TSS) visa which will support businesses in addressing genuine skill shortages.
The Temporary Skill Shortage visa enables employers to address labor shortages by bringing in skilled workers where employers can't source an appropriately skilled Australian worker.
The TSS visa is a temporary visa, the visa consists of the short-term, medium-term and labour agreement streams. The visa allows the applicant to work in Australia for up to four years. Especially for applicant who hold medium-term stream visa, if the applicant has worked for the same employer for 3 years on TSS visa he/she may be eligible for permanent resident visa via 186 or 187 TRT pathway.
Application requirement for sponsors:
• your business must be legally established and currently operating
• The department must not be aware of any adverse information about you or anyone associated with you that affects your suitability as a sponsor
• Employer must pay the Skilling Australians Fund (SAF) levy
(a) For small businesses (annual turnover less than AUD$10 million) – need to pay AUD$1,200 per year
(b) For other businesses (annual turnover of AUD$10 million or more) – need to pay AUD$1,800 per year
• The position associated with the nomination must be genuine
(a) Must conduct labour market testing

2. For Medium-term stream applicants, they must:

• have at least English language score that the overall band score of at least 5.0 with a score of at least 5.0 in each of the test component for IELTS or equivalent

Advantage of TSS 482 Visa:
• The TSS (482) Visa covers a wide range of occupations and skills. It has a lower requirement for applicant’s English language ability. Applicants who struggle to migrate via skilled migration may found it is more feasible to migration via TSS pathway
• The TSS (482) Visa does not impose strict requirement towards applicants’ and sponsors’ personal and business assets amount
• The TSS (482) Visa allow the primary applicant include dependents and spouses as secondary applicants. During the period of holding the TSS visa, holders can travel to and from Australia as many times as they want

The Prospective Marriage Visa (Subclass 300) is a temporary visa that enables the fiancé of an Australian citizen, Australian permanent resident, or eligible New Zealand citizen to come to Australia to marry their prospective spouse. The applicant must be outside of Australia at the time of application and time of decision. The applicant can stay in Australia for up to 9 months from date of grant, during the period, the applicant can work and study in Australia and the applicant can travel to and from Australia as many times as they want. If the applicant wants to settle in Australia, the applicant can apply for a Partner visa (Subclass 820 and 801) after the applicant married with their prospective spouse and before the prospective marriage visa expire.

Subclass 309/100 - Offshore Partner Visas
Subclass 309/100 Partner Visa enable the De-Facto partner or spouse of an Australian citizen, Australian permanent resident or eligible New Zealand citizen live in Australia. The applicant must be outside Australia at time of application and decision. Upon grant of Subclass 309 partner (Provisional) visa, the applicant will be assessed for permanent visa after 2 years passed providing the applicant and sponsor continue to meet relationship requirement. However, under certain circumstances the applicant might be granted the permanent visa within less than 2 years.
Visa Application Requirement:
The applicant:
Must meet the Department’s health and character requirement. There is no specific requirement regarding the applicants’ education background, work histories, English and financial capacities.
The sponsor:
• Must be an Australian citizen, Australian permanent resident or eligible New Zealand citizen.
• Must be at least 5 years since the sponsor were sponsored for, and granted, a Partner visa or Prospective Marriage visa.
• Must be at least 5 years since the sponsor sponsored 1 other person for a Partner visa or Prospective Marriage visa
• Can only sponsor up to 2 people for a lifetime period
Relationship Requirement: The applicant and sponsor must be either married or in a De-Facto relationship (include opposite and same sex) and the relationship must be genuine and been existing prior to the visa application.
For spouse (Married relationship): The marriage must be registered lawfully with authorities recognized by the Department of Home Affairs.
For De-Facto partner (De-Facto relationship): The De-Facto relationship must have existed for at least 12 months for it to be recognised for migration purposes.

Subclass 190/491 - The Australian Skilled - Nominated Visa
This Australian state sponsored visa is for skilled workers who are nominated by a state or territory. The applicant needs to submit an Expression of Interest then also need to apply for state sponsorship with an Australian state/territory. Once the applicant has been issued an Invitation to Apply, the applicant can continue to the DOHA stage of the application. The applicant needs to live in the nominating State/Territory for at least two years.
Visa Requirement
